In Stagg v. Vintage Place, Inc., (decided June 2010) the Court of Appeals determined that specific steps utilized in imposing discipline for attendance or punctuality issues need not be specified in personnel policy manuals or company handbooks. However, if the steps are published, they must be followed. Once published, an employer’s deviation from specified progressive discipline can undermine the “misconduct defense” to unemployment benefit claims.
